Marca inregistrata

Marca (de produs) protejata printr-un depozit constituit la OSIM (Legea 84/1998). Romania este semnatara a Conventiei de la Paris si a Aranjamentului de la Madrid privind protectia proprietatii industriale si inregistrarea marcilor internationale. Orice persoana fizica sau juridica poate inregistra una sau mai multe marci.

Pot fi inregistrate ca marci: cuvinte, inclusiv nume de persoane, desene, litere, cifre, elemente figurative, forme tridimensionale si, in special, forma produsului si a ambalajului, combinatii de culori etc. Inregistrarea marcii confera titularului dreptul exclusiv de folosire a marcii (pentru produsele si/sau serviciile pentru care s-a efectuat inegistrarea), pentru o durata nelimitata (daca inregistrarea va fi reinnoita din 10 in 10 ani).

Marcile pot fi individuale (apartin unei singure firme), colective (delimiteaza produsele/serviciile membrilor de cele ale concurentei) si marci de certificare (indica faptul ca produsele/serviciile pentru care marca este utilizata sunt certificate de titular in ceea ce priveste calitatea, materialele, modul de fabricatie etc).

Marcile inregistrate la OSIM nu sunt protejate decat pe teritoriul Romaniei. Conform Aranjamentul de la Madrid, se poate face inregistrarea internationala a unei marci – in una sau mai multe tari membre (pentru o durata de 20 ani, cu posibilitatea prelungirii) – printr-o cerere unica depusa la Organizatia Mondiala de Proprietate Intelectuala – OMPI, cu conditia ca aceasta marca sa fie inscrisa in registrul marcilor inregistrate in Romania.
