EC: De-politicize the reform of the judicial system

The Commission recommends efforts for political consensus so that the justice may function independently and produce rapid and efficient sentences. One of the biggest problems that the justice is confronted with refers to the slow procedures in court of law.

“Romania made progress in the justice reform compared to last year, when the Commission was worried about the pace of the reforms, but their implementation is still fragile, partly because of political pressure,” said EC’s Spokesman, Johannes Laitenberger. “Sometimes, the reform process is too politicized. Romania is still struggling to overcome the fact that these codes, Civil and Criminal, even though they are updated, have not been fully revised, which led to numerous legislative amendments and emergency ordinance,” the official added.

The Commission issued 16 recommendations in the field of justice, including “the government should finalize a new Criminal Procedure Code and make progress on the draft Criminal Code. This would provide a clearer and effective framework for prosecution and allow better cooperation with other Member States” and “independent investigation of former ministers and members of Parliament by the judicial authorities must be allowed to proceed in order to restore public confidence in the fight against corruption and in respect for the rule of law.”
