CNVM’s order refers strictly to the “entities regulated and supervised” by this institution, while Fondul Proprietatea is not registered with the Commission.
A government ordinance issued in 2007 indicated that Fondul Proprietatea will register with the Commission as an other collective placement body (AOPC), established for the purpose of granting damages involving real estate units which cannot be returned in kind. But the Fund delayed registration with CNVM, due to obstacles related to drafting an investment policy and the structure of its portfolio.
The management of Fondul Proprietatea said that FP’s by-laws allow the fund to report to CNVM’s dispositions in terms of accounting regulations.
