According to the law 221 on 2009, any person that suffered political conviction during March 6 1945 – December 22 1989, as well as the spouse or the close relatives in case that person died, can ask a court within three years since the law entered into force to make the state pay some compensations for the moral prejudice suffered through the conviction. However, the law failed to settle the way these compensations are calculated, reason why a unitary treatment for those that suffered political convictions is not accomplished, said Muntean, explaining the reason for which the Executive decided to adopt this ordinance.
Thus, a person that suffered a political conviction during March 6 1945 - December 22 1989 can receive up to 10,000 euros, while the spouse or the first-degree relatives 5,000 euros and the second-degree relatives 2,500 euros.
The emergency ordinance also foresees the court to take into consideration while establishing the amount of the compensation the interval of conviction, the period of time past since the conviction and the negative consequences prompted by the conviction.
The court of Bucharest decided on June 11 to grant moral compensation worth 500,000 euros to the former head of PNTCD party Ion Diaconescu, for his distress during the communist period, as the conviction sentences were political. The decision is not definitive.
The former head of PNTCD sued the state and required damages of 18 million euros for the traumas he suffered during the detention from the communist prisons.
