Another cause for aggravation is the lack of recognition by the National Energy Regulatory Authority (ANRE) of various expenditures by the above-mentioned energy giants, who are therefore unable to recover these through tariffs. Nicolae Opris, Vice President in charge of the energy market for ANRE, indicated that “the CFR problem has become so severe due to the law that protects this company, abusing its position as consumer whose supply cannot be interrupted.”

As concerns accusations by operators that ANRE does not recognize expenditures in the past two years, the same expenses which it recognized in the 2006 electoral year, Opris said “we are sorry for these inconveniences.” CFR officials say they have no funds to pay off debts worth some €250 million, have applied to the Minister of Finance, bu have not yet received a response. The Director of Energy and Utilities of the Romanian-American Investment Fund (RAIF), Valeriu Binig, believes that investors must have courage to sue ANRE.
