As of 1 January 2010, when the new pension law goes into effect, the government plans to recalculate all special pensions being paid at present, which will be set according to the contributions their beneficiaries made to the social security system, Mihai Seitan, State Counselor on Social Matters, initially announced.
Seitan added afterwards that the state could decide to recalculate only the pensions exceeding a certain ceiling, set at €10,000. However, according to official data, the highest special pensions amount to some €9,000. The government has not yet made a clear decision with respect to this subject, and the single pension law is still being debated at the expert level.
“I believe that lowering pensions that are currently being paid is wrong, considering that these rights were earned based on valid laws, which were in effect when their beneficiaries retired. Anybody turning to a court of law for this reason has chances of winning, and the state will be forced to pay the pensions, plus arrears and damages, which will mean amounts three-four times higher than its initial obligation,” said the President of the Projust Federation, Stefania Teleman.
